These Terms of Use ("Terms") govern your access to and use of the Byotone website (the "Site"), operated by OUTSTANDING CONTRIBUTION TO THE MODERN MOVEMENT LLC., Los Angeles, California ("Byotone," "we," "us"). By accessing or using the Site, you agree to these Terms.
1. Nature of the Site
The Site is provided solely to present information about Byotone's services and approach, including educational content and references to scientific or technical research. The Site is not an online store and does not process payments. Bookings and commercial engagements are concluded through third-party platforms or separate written agreement, under their own terms; we exercise no control over, and assume no responsibility for, third-party websites or services linked from the Site.
Nothing on the Site constitutes a binding offer, and no client, professional, therapeutic, medical, or fiduciary relationship is created by your use of the Site or by contacting us through it.
2. No Medical Advice
Byotone provides sound-based experiences intended for relaxation and general wellbeing. Such experiences do not constitute medical advice, diagnosis, treatment, or therapy, and are not a substitute for consultation with a licensed healthcare professional. References to scientific research appearing on the Site are provided for general information only; they describe published findings and constitute no representation as to the effects of our sessions, and individual results vary.
Sessions involve prolonged exposure to sound, including low frequencies perceptible as physical vibration. Persons who are pregnant, or who have epilepsy or a seizure disorder, tinnitus or hyperacusis, a cardiac condition, an implanted electronic device, or a psychiatric condition, should consult a physician before attending. Participation is voluntary and undertaken at your own risk.
3. Site Content and Conditions of Use
All content on the Site, including audio recordings, compositions, visual works, text, software, and the Byotone name and marks, is owned by or licensed to us and protected by intellectual property laws. You may access and share the Site for personal, non-commercial purposes only. Reproduction, sampling, redistribution, the creation of derivative works, and use of Site content for the training of machine-learning systems are prohibited absent our prior written consent.
You further agree not to use the Site unlawfully, to submit unlawful or infringing material, to scrape or systematically extract Site content, or to interfere with the operation or security of the Site. The Site contains animated visuals and audio; audio is played only upon user activation.
4. Voice Recordings
The Site's contact facility records an audio message in place of text fields. Recording commences only upon your activation and is transmitted only upon your confirmation. By submitting a recording, you consent to being recorded and represent that you are at least eighteen years of age, that you are the speaker, and that no other identifiable person has been captured without their consent. You should not include health, financial, or other sensitive information in a recording. Such recordings are used solely to review and respond to your enquiry; they are never published, used for promotional purposes, published as testimonials, or processed to generate a voiceprint or otherwise identify you biometrically. They are retained only for so long as necessary to address the enquiry and are thereafter deleted, or deleted earlier upon your request.
Audio testimonials published on the Site are obtained separately, from persons who have attended a Byotone session and who have given written consent to the publication of their recording, name, and professional role, granting us a non-exclusive, royalty-free licence to reproduce and publish it. Consent may be withdrawn at any time by written notice, whereupon the testimonial will be removed within a reasonable period. Testimonials describe individual experiences and constitute no representation as to results.
5. Privacy
We collect only the personal information you elect to provide, namely voice recordings and any contact details contained therein or in correspondence with us. Such information is used solely to respond to your enquiry and to provide our services, and is disclosed only to service providers acting on our behalf under contract, or where required by law. We do not sell personal information and do not share it for cross-context behavioural advertising.
Site analytics are provided by Plausible Analytics, which employs no cookies and no persistent identifiers, performs no cross-site tracking, and reports aggregate page-level data only, by which we are unable to identify individual users. Any cookies employed are strictly necessary to the functioning of the Site, and the Site does not respond to Do Not Track signals.
Residents of California may request to know, access, correct, delete, or obtain a portable copy of their personal information, and shall not be subject to discrimination for exercising such rights; visitors from the European Union and the United Kingdom may exercise equivalent rights under applicable law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively before the state or federal courts sitting in Los Angeles County, California, to whose jurisdiction the parties consent. We may amend these Terms at any time; the date stated above indicates the current version, and continued use of the Site following any amendment constitutes acceptance thereof.
